N.C. A&T Scores Big with Union Square Partnership   8/5/2016

The greater Greensboro community has anxiously awaited the opening of the Union Square Campus for several years. The ribbon cutting ceremony finally arrived on Friday, Aug. 5 and no other entity was as excited or proud as North Carolina A&T State University.  As one of the campus’ inaugural and pioneering tenants, along with the University of North Carolina at Greensboro, Guilford Technical Community College, and Cone Health, N.C. A&T will house its accelerated Bachelor of Science in Nursing and Registered Nurse-Bachelor of Science in Nursing Completion entry programs.

"Union Square Campus is an innovative approach to training our future leaders in health care. It will redefine traditional methods and is a way to strengthen public and private partnerships here in the Triad,” said Chancellor Harold L. Martin Sr. “It’s exciting to see this national model unfold.”

Notwithstanding HBCU NCA&T lease fee of $587,500 was the same amount as GTCC; NCA&T 3000 sq. ft. of fixed space was half GTCC 6000 sq. ft. of fixed spaced. UNCG received 12,000 sq. ft. of fixed space for an annual lease fee of $775,000, four time more fixed space than NCA&T 3,000 sq. ft. of fixed space for only $188,000 more annual lease fee.  Cone Heath annual lease fee of $ 470,000 for 500 sq. ft of fixed space was the least of the Leases; whose projected enrollment of 2,800 staff member constituted 81 % of the total enrollment.

THE UNIVERSITY OF NORTH CAROLINA 2013-15 Capital Budget Priorities call for UNCG Nursing/Classroom/Office Building 2014-15 Request (planning) – $13,133,200. The project would house the School of Nursing, which would occupy approximately 50% of the space.  Currently located in four buildings and space constrained, this project would allow the School of Nursing to expand its enrollment and realize the collaboration and efficiency benefits possible by being in one location.  Note: THE UNIVERSITY OF NORTH CAROLINA 2013-15 Capital Budget Priorities called for new facilities for NCSSM, UNC, UNCW, ASU, UNCC, UNCG, and ECU but no HBCU’s.    March 15, 2016 bond issue approved providing a $105 million Nursing/stem building at UNC-G. NCA&T existing Nursing facilities consisted of 48, 000 Sq. Ft. refurbished Noble Hall. Adjacent Hines Hall was renovated ($1,700) in 2013to house NC A&T Simulation Center and Virtual leaning lab. NCA&T average Nursing enrollment 2009-2013 was 119students. The NCA&T (Tenant) projected 105 enrollment at Union Square constitute 88% of the average enrollment and 25,000 sq. ft. lease constitute a 50% expansion for Nursing facilities, at a time when the BOG was considering terminating the largest component of NCA&T’s BSN program - traditional nursing program. NCA&T will offer classes in this location for students in both its Accelerated Second Degree (ABSN - a program whereby individuals who already possess a bachelor's degree take an accelerated program to earn a degree in nursing) and RN-BSN (BSNC- those students who have already passed the nursing exam, but have not earned their bachelor's degree) programs. The Tuition in State for the ABSN and RN-BSN is $5420(1 year) and RN-BSN is$3534 per year, neither program Tuition will cover the approximate $6000 per enrollee lease payment to Union Square. Combining Union square public record information and figures in the public domain, based on maximum lease costs, leases will cost NC A&T $6000 , GTCC $$4, 200 and UNCG $ 9,500 per enrollee but will only cost Cone Health 168 per enrollee.  Cone Health 2,800 enrollees is seven times the Public University enrollment whose lease fee of $470,000 is the least lease fee for a token 500 sq. ft. of fixed space.  A&T will receive only 3000 sq. ft. while GTCC will receive 6,000 sq. ft. of fixed space for the same Lease fee of $587,500. UNCG enrollment of 232 is two hundred enrollee greater than the 32 students projected in their request to establish DNP degree which also said the university could house the program for three years using existing facilities.  Furthermore UNC Board of Governors 2015-16 & 2016-17 Strategic Capital Priorities call for spending $124,765,400 for UNCG Nursing and Instructional Building. 
 
 
The facility is expected to cost about $37 million including equipment.  The balance will be paid by debt service funded by lease payments from the tenants.

As you know, NCA&T and UNCG desire to present an item for action to the BOG, seeking authority to work with DOA and Council of State to enter a lease for space for our nursing programs.  Union Square Campus Inc. a non-profit entity formed for this collaboration will construct academic, laboratory and support facilities for the benefit of the Universities which would then be leased back to the Universities for a lease term of ten years.  It is anticipated that the space would be available by fall 2016 and a would allow for the accommodation of space needed for the Universities nursing programs.

I have also taken the liberty to draft language that you may wish to use as a starting point for the action item. It is also attached.
 


Proposed Action Item Draft say: The lease of this space will be accomplished within the guidelines, procedures and policies of the North Carolina Department of Administration and the Council of State.  It is recommended that the following resolution be approved and the request of the Universities be transmitted to the Council of State for final action.
NCA&TSU anticipates leasing approximately 25,000 sq. ft. at between $18 and $23.50 per sq. ft. per year. Total yearly lease payments would be between $450,000 and $587,500. This space would house enrollment expansion in the Bachelor of Science in nursing program and allow current students more access to state-of-the-art laboratory space.

UNCG anticipates to lease approximately 33,000 sq. ft. at between $18 and $23.50 per sq. ft. per year. Total yearly lease payments would be between $594,000 and $775,500. This space would house the new Doctor of Nursing Practice program, approved by the Board of Governors on February 21, 2014, as well as enrollment expansion in the Bachelor of Science in Nursing program.

The facility is intended to focus on healthcare professionals and will house expansion of the Universities’ programs in nursing, and Greensboro’s healthcare system, Cone Health, will use the facility to train staff.

It is recommended that North Carolina A&T State University be approved to lease up to 25,000 square feet at no more than $587,500 a year for 10 years and that The University of North Carolina at Greensboro be approved to lease up to 33,000 square feet at no more than $775,500 a year for 10 years, from USCI.

Acquisition of Space by Lease - NCA&TSU and UNCG: A vote was taken by the committee on the recommendation, which did pass committee and  on the Consent agenda by the full Board of Governors.

 A&T) corrective action plan and will continue to closely monitor the school's progress.  UNC President Thomas Ross non-complaint with  Board Policy did not request the Board initial procedures for NC A&T Nursing program termination. Notwithstanding President Ross had not requested the Board initiate termination procedures the Board on its own Motion move that new admissions to the nursing program be suspended for all students admitted after 2014 and a panel convened within sixty (60) days to review possible program elimination at North Carolina A&T State University.

In its April 2014 meeting, the University of North Carolina (UNC) Board of Governors completed its annual review of the National Council Licensure Examination for Registered Nurses (NCLEX-RN) first-time writers’ pass rates for graduates of the nursing programs across the University system. Subsequent to that review and in keeping with UNC Board of Governors policy 400.1.7, the Board suspended new admissions to the BSN program at North Carolina Agricultural & Technical State University (NCA&T) after 2014 and called for a full review of the program, emphasis added.
 

Specifically, the motion approved by the Board was as follows:
 

“The 2013 Nursing Report is for informational purposes only and does not require a motion to accept. However, in 2012 North Carolina A&T State University received a waiver from the Board of Governors’ policy which would have required the initiation of program termination procedures. This waiver was granted under the condition that North Carolina A&T State University 2013 test takers would meet Board of Governors’ NCLEX-RN passing rate standards. I move that new admissions to the nursing program be suspended for all students admitted after 2014 and a panel convened within sixty days to review possible program elimination at North Carolina A&T State University.”

 

In his May 2014 charge to the review team, UNC President Tom Ross requested “a full and comprehensive review of program strengths and weaknesses, student demand and employer need for additional baccalaureate nurses, the full costs of program delivery, and potential net savings (or losses) to the institution, the system, the state, and employers of full or partial program closure.” Emphasis added

 
 
April 10, 2014, UNC Board of  Governors' Committee on Education Planning, Policies, and Programs  received the  2014 annual  Nursing (NCLEX-RN) report for academic year 2013 whose minutes allege : "After representatives from North Carolina A&T State University responded to Committee questions, and after Committee discussion, Mr. Mitchell made the following motion ...."
 
NCA&T Executive Committee Meeting  Minutes April 25, 2014 allege: Chancellor Martin shared that Mrs. Williams was in attendance and neither of them were given an opportunity to make remarks about the program prior to the motion being made. That shut down the program (nursing) would have gone against the policy. Mr. Deese suggested that the Board of Trustees send a letter to the BOG about our discontent about their willingness to breach policy and do A&T damage.   video/audio

I have attached the BOG minutes for that Item.  It appears that the authorization from BOG does not require us to forward it to SPO/COS.  The only document that mentions it is the letter from Charlie P to Chancellor Brady (attached).

April 24, 2014, UNC General Administration President Dr. Thomas Ross  reported to the Committee on Budget and Finance his approval of  University of North Carolina at Wilmington - Disposition of Real Property by Lease. The write up says the President was authorized to approve Delegated Campuses that can  self-approve leases valued annually up to $500,000.  NC A&T and UNCG are not Delegated Campuses that could self-approve leases therefore were not eligible for President of  UNC System delegated authority to approve  Union Square leases; Furthermore NC A&T and UNCG  maximum Union square lease value of $587,000 and $775, 000 exceed the President authority of $500,000.

DEVELOPER’S OBLIGATIONS FOR DEVELOPMENT OF AND IMPROVEMENTS TO PROPERTY


Whereas the schedule for the project, subject to receipt of all anticipated sources of funding, proposes construction beginning in early 2015 and completion and opening of the first building of the campus in the summer of 2016. The City Council herby directs the City Manager and staff, working with the organizers of Union Square Campus, the Redevelopment Commission and Master Developer, to develop a funding methodology that utilizes current and anticipated revenues from existing City revenue sources to help support the following items: Provide up to 2 acres of land within the site and 250 parking spaces (surface or as part of a deck to service multiple users) at no cost to the Campus and, provide up to $500,000 toward site development, other infrastructure, and construction costs. In addition, the City Manager and staff are directed to begin development of a plan to enhance the street scape in the vicinity of the site. Clearly ANNUAL REPORT OF THE COMMITTEE ON BUDGET AND FINANCE TO THE BOARD  indicated  UNC Board of  Governors approved Acquisition of Space by Lease  subject to approval by the State Property Office, and accomplished within the guidelines, procedure, and policies of the North Carolina Department of Administration.
 
The Department of Administration § 143-341(4) (a) has the following powers and duties: To prepare and keep current a complete and accurate inventory of all land owned or leased by the State or by any State agency. UNC Regulations on Required Clearances for Real Property Transactions , ( 5)

Copies of all real property instruments must be filed with the Department of Administration. Every six months the institution is to make a report to the Department of Administration on the status of all leases.

Hiding truth in plain sight, NCA&TSU Chancellor  Martin  and allegedly UNC Greensboro Chancellor Linda Brady proceed to  claim to be duly authorized to execute Leases North Carolina A&T State University and The University of North Carolina Greensboro  (Tenants), Union Square Campus, Inc. (Landlord.)   Acquisition and Disposition of Real Property by Lease Transactions using Delegated Authority lease agreements shall be in the name of the constituent institution or the University of North Carolina.
   
   
Notwithstanding: Union Square Campus, Inc. (Landlord)  and  North Carolina State University (Tenant)  and UNC Greensboro (Tenant) Real  Property Leases were not approved by the State Property Office ((NCGS.§ 116-3), nor pursuant UNC President delegated authority (NCGS. §116-31.12, and §600.1.3.1 and 600.1.3.1[R], therefore unauthorized.  In consistent with  UNC Board of Governor approved motion to examine costs of the nursing program at NC A&T State University as enrollment and staff numbers change in the School of Nursing, encouraging NC A&T school of Nursing to consider cost-per-student savings opportunities through enrollment increases, lower-cost teaching resources, and other strategies. NC A&T Chancellor Dr. Harold Martin claiming being duly authorized to do so,...acknowledge the execution of the foregoing instrument (lease) on behalf of the corporation. Martin unlawfully executed lease with Union Square Campus, Inc., at a cost of approximate $6000 per student, for up to $587,000 for 10 years.  

Bogus UNC Greensboro (Tenant) alleged UNCG Chancellor Linda Brady signed  Union Square Campus, Inc. Lease called for spending up to $775,000 for ten years.  Todd Davis Associate General Counsel, The University of North Carolina at Greensboro, UNC GA approval for lease acquisition specific to this property does not exist because UNCG management flexibility provides Chancellor-level authorization to sign this level lease agreement,  Public Record Request reply email March 13, 2015.

 
Proposal Acquisition of Space by Lease - NCA&TSU and UNCG was held by the (UNC) Committee on Budget and Finance April 10, 2014 which said NCA&TSU anticipates leasing approximately 25,000 sq. ft. at between $18 and $23.50 per sq. ft. per year; UNCG anticipates to lease approximately 33,000 sq. ft. at between $18 and $23.50 per sq. ft. per year.
Pursuant Public Record Documents, allegedly UNCG Chancellor Linda Brady signed Lease Agreement Jan. 14th  2014 several months prior to submission of  Acquisition of Space by Lease - NCA&TSU and UNCG to (UNC) Committee on Budget and Finance. The location of Union Square Campus , Corner of South Elm and Lee Street, Greensboro, NC  changed to corner of Lee Street and Arlington Street. Notwithstanding Lease Agreement was unauthorized by the State Property Office. Was not approved pursuant UNC President delegated Authority; UNC  Office of General Counsel claimed upon review of the document (lease) is determined to be in compliance with University policies and applicable laws.

N.C. A&T Scores Big with Union Square Partnership

The greater Greensboro community has anxiously awaited the opening of the Union Square Campus for several years. The ribbon cutting ceremony finally arrived on Friday, Aug. 5 and no other entity was as excited or proud as North Carolina A&T State University.

As one of the campus’ inaugural and pioneering tenants, along with the University of North Carolina at Greensboro, Guilford Technical Community College, and Cone Health, N.C. A&T will house its accelerated Bachelor of Science in Nursing and Registered Nurse-Bachelor of Science in Nursing Completion entry programs.

The partnership is a result of A&T’s continued effort and commitment to remain on the cutting edge in collaboration and innovation. As a stakeholder and tenant of the Union Square Campus, the university continues to fulfill the mandates and requirements necessary to obtain its strategic goals of Preeminence 2020.

"Union Square Campus is an innovative approach to training our future leaders in health care. It will redefine traditional methods and is a way to strengthen public and private partnerships here in the Triad,” said Chancellor Harold L. Martin Sr. “It’s exciting to see this national model unfold.”

The 84,000 square feet campus, replete with state-of-the-art simulation and virtual technology will allow A&T’s School of Nursing to create transformational learning experiences for all of its nursing students. With highly-skilled nurses projected to continue to be in high demand, A&T is preparing a professional workforce as well as industry leaders.

Addressing an overflowing crowd, in the 340-seat auditorium, Pat Danahy, Union Square Campus board chairman, applauded the inaugural tenants for being part of a model of collaboration and funding that will yield dividends throughout the immediate community and for the common good.
